Quick answer

Every company must furnish its income tax return (Form C) within seven months from the date following the close of its accounting period (Income Tax Act 1967, s.77A) and submit a tax estimate (Form CP204) at least 30 days before its basis period begins (s.107C). A Tax Identification Number (TIN) with LHDN is the prerequisite for both, and it is also the identifier required for MyInvois e-invoicing. We register the company and hand over the TIN.

Overview

A newly incorporated company is not automatically registered for tax. Before it can file anything with the Inland Revenue Board of Malaysia (LHDN), it needs its own Tax Identification Number.

The TIN is the key to every corporate tax obligation that follows: the annual return of income under Section 77A of the Income Tax Act 1967, the estimate of tax payable (CP204) under Section 107C, and — for companies above the e-invoicing threshold — the MyInvois identifier used on every e-invoice.

The timing matters more than companies expect. The first CP204 is due soon after the company starts its first basis period, and missing it attracts penalties. Registering early, and diarising the first estimate at the same time, avoids starting the company's tax history with a late filing.
