FAQ

Foreign-owned setup & MPK licence — frequently asked questions

Can a 100% foreign-owned company be registered in Malaysia?
Yes. Malaysia allows a wholly foreign-owned private limited company (Sdn Bhd) in most sectors. The company is incorporated with the Companies Commission of Malaysia (SSM), can be held 100 percent by foreign shareholders, and has its own legal identity, just like the Malaysian arm we set up for Jinsin Technology.
What is an MPK (Majlis Perbandaran Kulim) business licence?
An MPK business licence is issued by Majlis Perbandaran Kulim, the Kulim municipal council. Any business operating from premises within the council area must hold this licence to trade legally, and it confirms the premises and activity are approved by the local authority.
Do I need an office and tenancy agreement before getting a business licence?
Yes. A council business licence is tied to a specific premises, so you need a suitable office and a proper tenancy agreement in place first. The premises address and tenancy form part of the licence application lodged with the council.
What is involved in setting up a foreign-owned Sdn Bhd?
Setting up a foreign-owned Sdn Bhd involves reserving a company name, preparing the constitution and incorporation documents, registering with SSM, and appointing a licensed company secretary. From day one the company also needs a registered address and statutory records kept in order.
Can ONEKEY BIZ handle company setup, office tenancy and the licence together?
Yes. ONEKEY BIZ handles the whole journey end to end, from incorporating the foreign-owned Sdn Bhd, to sourcing an office and drafting the tenancy, to lodging and obtaining the MPK business licence, so your Malaysian base is legally up and running.
